This agreement governs the relationship between Istanbul Workshops and the participant who takes part in its workshops. By making a reservation or attending a workshop you accept these terms.

01Parties

1.1. This User Agreement (the “Agreement”) is made between İstanbul Workshops Eğitim ve Danışmanlık Limited Şirketi (“Istanbul Workshops”), registered at Aziz Mahmut Hüdayi Mah. Eski Mahkeme Sk. No: 14 Interior door No: 7, Üsküdar / Istanbul, Türkiye, and the natural or legal person who benefits from the workshop services offered by Istanbul Workshops and accepts this Agreement electronically or in writing (the “Participant”), on the terms set out below.

1.2. Istanbul Workshops and the Participant are referred to individually as a “Party” and together as the “Parties”.

02Definitions

Workshop
Creative and/or educational sessions delivered by the instructors engaged by Istanbul Workshops, under its control, at its own venue or another venue it designates, and carried out together with participants,
Platform
The website, mobile application and other digital environments of Istanbul Workshops that allow workshops to be reserved or purchased,
Content
All material, images, designs, ideas, works and products used and/or produced within the scope of the workshops,
Legislation
All legislation in force within the Republic of Türkiye.

03Subject

3.1. The subject of this Agreement is to set out the procedures and principles for the Participant’s use of the workshop services offered by Istanbul Workshops, together with the rights and obligations of the Parties.

3.2. By accepting this Agreement, the Participant agrees to comply with all terms and conditions set out here in every transaction carried out to attend workshops, whether through the Platform or in person.

04Registration and reservation

4.1. The Participant is obliged to provide the personal information requested by Istanbul Workshops accurately and completely, and undertakes that the information given is correct.

4.2. Registration and reservation may be completed through the website, the mobile application or other reservation channels of Istanbul Workshops.

4.3. The reservation fee must be paid in part or in full for the reservation to be completed. Completing the reservation grants the right to attend, provided the Participant complies fully with this Agreement.

4.4. Istanbul Workshops has the right to refuse a registration or reservation request where it considers this necessary.

05Payment and cancellation

5.1. Workshop prices are as stated on the website, the mobile application or other reservation channels of Istanbul Workshops, and include VAT. Prices may differ between platforms; in that case the price set on the platform where the ticket is issued applies.

5.2. Payments are made using the payment methods determined by Istanbul Workshops, which may change them at any time.

5.3. Cancellation and change tiers

More than 24 hours before the workshop
100% of the amount paid is refunded, or transferred to another workshop at the Participant’s choice.
12–24 hours before the workshop
50% of the amount paid is refunded, or transferred to another workshop at the Participant’s choice.
Less than 12 hours before the workshop
No refund is made; the amount paid may be transferred to another workshop at Istanbul Workshops’ discretion.

5.4. Istanbul Workshops may cancel or postpone a workshop where participant numbers are insufficient, the instructor falls ill, or in cases of force majeure or other compelling circumstances. The Participant is informed as soon as possible and, at their choice, the amount paid is refunded in full or transferred to another workshop.

06Workshop rules

6.1. The Participant undertakes to arrive at least 15 minutes before the stated start time. Latecomers may be admitted at a point that does not disrupt the session; no refund or discount is given in that case.

6.2. The Participant is obliged to follow the instructions of the instructors and staff throughout the workshop.

6.3. The Participant undertakes not to behave in a way that adversely affects other participants’ experience. Istanbul Workshops may remove a participant behaving inappropriately; no refund is given in that case.

6.4. The Participant undertakes to use the materials, equipment and venue with care and accepts responsibility for damage caused by deliberate or negligent behaviour.

6.5. The Participant accepts that they attend of their own free will and that Istanbul Workshops is not responsible for accidents or injuries that may occur during the session.

6.6. The Participant undertakes not to be under the influence of alcohol or drugs during the workshop. Istanbul Workshops may remove a participant believed to be under such influence; no refund is given in that case.

6.7. Participants under 16 may attend only accompanied by a parent or legal guardian. Participants aged 16–18 may attend with the written permission of a parent or legal guardian.

07Intellectual property

7.1. All intellectual property rights (including copyright, design rights, patent rights, trademark rights, know-how and trade secrets) in the content, materials, methods, techniques and concepts provided by Istanbul Workshops within the workshops belong exclusively to Istanbul Workshops.

7.2. The Participant owns the works they produce during the workshop but grants Istanbul Workshops the following irrevocable rights over those works:

a) the right to photograph and film the works and to use that audio-visual material in any medium for promotional, marketing and educational purposes; b) the right to use the works on the Istanbul Workshops website, social media accounts, printed materials and other promotional channels; c) the right to exhibit the works and use them at events organised by Istanbul Workshops.

7.3. The Participant undertakes not to use, reproduce, distribute or teach to third parties the techniques, methods and concepts learned during the workshop for commercial purposes beyond personal use.

7.4. The Participant undertakes not to reproduce or distribute the materials, documents and content provided, and not to share them with third parties without written permission.

08Processing of personal data

8.1. Istanbul Workshops processes and protects the Participant’s personal data under Personal Data Protection Law no. 6698 (“KVKK”).

8.2. The Participant gives express consent to the processing of their personal data for: carrying out workshop reservations and payments; providing information about the services offered; providing personalised content and services based on preferences and interests; analysis and research to improve service quality; and fulfilling legal obligations.

8.3. Istanbul Workshops does not share personal data with third parties without the Participant’s express consent, other than with service providers (payment institutions, reservation platforms and the like) and official authorities within the scope of legal obligations.

8.4. The Participant may exercise their rights under KVKK (access, rectification, erasure, objection and the like) by applying to Istanbul Workshops in writing.

8.5. The Participant acknowledges having read and understood the Privacy Policy and the Cookie Policy.

09Photographs and video taken during workshops

9.1. Istanbul Workshops may take photographs and video during workshops. The Participant gives express consent to the use of such material: for publication on the website, social media accounts and other digital platforms; in promotional, marketing and advertising materials; in press and media outlets; and at events organised by Istanbul Workshops.

9.2. The Participant has the right to inform staff before the workshop begins that they do not wish to appear in photographs or video.

10Limitations of liability

10.1. Istanbul Workshops is not liable for direct or indirect damage arising from accidents, injuries or health problems that may occur during workshops. The Participant accepts that they attend at their own risk and responsibility.

10.2. The Participant undertakes that their health permits attendance and that they will inform staff in advance of any health problem or allergy.

10.3. Istanbul Workshops is not responsible for the loss, theft or damage of personal belongings used by the Participant during the workshop.

10.4. Istanbul Workshops is not liable for damage arising from the cancellation or postponement of workshops due to force majeure (natural disasters, epidemics, war, terrorism, strikes, lockouts, government restrictions and the like).

11Governing law and dispute resolution

11.1. This Agreement is governed by the laws of the Republic of Türkiye.

11.2. The Istanbul (Central) Courts and Enforcement Offices have jurisdiction over disputes arising from this Agreement. For participants who qualify as consumers, the right to apply to the Consumer Arbitration Committees and Consumer Courts within the monetary limits set by the Ministry of Trade is reserved.

12Amendments

12.1. Istanbul Workshops may amend the provisions of this Agreement at any time. Amendments take effect on the date they are published on the website.

12.2. A Participant who attends a workshop after amendments take effect is deemed to have accepted the amended Agreement.

13General provisions

13.1. If any provision of this Agreement is held invalid, the validity of the remaining provisions is unaffected.

13.2. By accepting this Agreement electronically or in writing, the Participant declares that they have read, understood and accepted all of its provisions.

13.4. This English text is a translation provided for convenience. The Agreement is governed by Turkish law and, in the event of any inconsistency, the Turkish text prevails.
